20th December 2007 - Land and Environment Court on site hearing

Commissioner Hoffman’s report was received by the residents on the 15th November 2007 and as the parties involved could not agree to a settlement the matter now proceeds to an investigation of the issues.

Land and Environment Court Proceedings have been fixed for an on site hearing to take place opposite the Caroline Chisholm Drive entrance to the Shoppng Centre at 9:30am on Thursday 20th December 2007.

Residents will have an opportunity to address the Commissioner and raise their concerns relating to the Shopping Centre Management’s proposal.

All concerned residents are urged to attend this hearing.

Preliminary Conciliation Conference conducted by Commissioner K Hoffman

A number of Winston Hills Residents Action Group members and residents attended the on site conciliation conference together with solicitors representing the Baulkham Hills Council and The Winston Hills Mall. A parking consultant acting on behalf of the Mall was also present

The Commissioner heard submissions from the Solicitor acting for Baulkham Hills Council, the Winston Hills Mall Management, Solicitor and Parking Consultant then every resident who wished to make a submission was able to do so. Everyone was given ample time to state their case with the Commissioner listening carefully to all parties. All residents felt the Commissioner had given them a fair hearing.

Following the submissions the Commssioner carried out an inspection of the parking areas of the Mall and walked around the whole complex with a number of the residents.

A meeting was then held in the Mall offices where the residents could observe but not take part. The Commissioner took comments from both solicitors and prepared his draft notes on the proceedings. A formal report by the Commissioner is expected in several weeks time.

The residents await Commissioner Hoffman’s findings.
